Section 234 & 235 renting homes (wales) act 2016

We (Caerphilly Homes) must consult with you (as a contract-holder) on certain housing management matters – it’s the law. This is because the Renting Homes (Wales) Act 2016 (section 234) sets out the legal obligations that we as a Community Landlord must follow when consulting with you on proposed changes to housing management matters.

We must consult when all contract holders, or a relevant group of contract holders, are likely to be substantially affected by proposed changes to a relevant housing management matter. These are called “relevant matters” and would include proposed:

  • new maintenance programmes, improvement, or demolition; or
  • changes to the practice or policy regarding management, maintenance, improvement or demolition;

We also must provide a reasonable opportunity for you to comment on the relevant matters. The law also says we must consider any comments made by you before making our final decision.

These Consultation Arrangements are published in line with the Renting Homes (Wales) Act 2016 (section 235). The arrangements set out how we will inform you of any relevant matters and how you can make your views known to us.

Type of Consultation:

As well as consulting with you in line with the law (as above), we may also wish to gather your views on a wide range of housing matters to improve our services to you. These consultations are not governed by law but are conducted as part of our commitment to improving our services.

How we will tell you about the consultation:

Caerphilly Homes is committed to ensuring that:

  • Information is available on the consultation.
  • You (as a contract holder) are aware of what the consultation is all about
  • You (as a contract holder) know how you can get involved in the consultation.
  • Where appropriate, following the consultation we will provide information on the outcome of a proposal and explain how we have used the results to inform our decision.
  • Where relevant, we will include financial implications.

We will communicate with you at the start of the consultation setting out the arrangements and how you can respond. Information on the consultation may be included within our newsletters and social media platforms. We may consider whether support organisations should also receive information regarding the consultation.

How you can make your views known:

Each consultation will be tailored and may have different arrangements in place for you (con- tract-holders) to make your views known. These may include:

  • online surveys
  • focus groups
  • email
  • telephone
  • writing
  • in person

If you have support, you may want to ask them to help you share your views with us. Also let us know if you need any other arrangements to make it easier for you to tell us your views.

How long will you have to respond to the consultation:

This will depend on the proposal being considered. We will provide a reasonable timeframe for any consultation, and this will likely be at least 4-weeks. The timeframe will depend on what we are consulting on and will be made clear to you at the beginning of the consultation.

How do we decide if a consultation is needed:

To help us decide if we should consider proposing a change to a relevant matter we may ask your views on a particular subject. This would not be part of the consultation process described above.

If after seeking your views, we decide to put forward a proposal to change a relevant housing matter that will affect all, or a relevant group of contract holders, we will consult in line with the Renting Homes (2016) Act.
