Consultation on Review of Statement of Policy Licensing Act 2003

We are currently reviewing our Statement of Licensing Policy in respect of the Licensing Act 2003. 

The statement of licensing policy aims to secure public safety, protect children from harm, prevent public nuisance and prevent crime and disorder whilst encouraging a sustainable leisure and entertainment industry.

The Licensing Act 2003 requires that Licensing Authorities publish a Statement of Licensing Policy which sets out the various factors that they will take into account and consider in the administration and determination of applications made under the Act in relation to the promotion of the Licensing Objectives. 

The council recognises both the expectations of local residents for a safe and healthy environment in which to live and work, and the need for the provision of safe and well conducted entertainment, hospitality and leisure facilities throughout the borough.

Our current policy came into effect on 1 January 2016 and is now subject to review.

Below are some of the proposed amendments to the existing policy:

  • An update of the implications of drug and alcohol harm provided by Public Health.
  • Best Practice guidance in relation to prevention of crime and disorder
  • Sets out measures on how to prevent and report sexual exploitation, modern day slavery and human trafficking.
  • Prevention of public nuisance working with partners such as environmental health and referral to Welsh Governments Noise and Soundscape Action plan 2018-2023
  • Public Safety – provides advice on risk assessments and control measures.
  • Protection of children from harm, including safeguarding advice and underage sales.
  • Provides advice on how the licensing authority will deal with petitions in support of or objecting to applications.  

As a part of the consultation exercise, we intend to contact those persons, businesses or organisations that are likely to be affected by the policy to seek their views.

The consultation period will start on 14 August 2020 and end on 9 October 2020. If you wish to make comments you will need to do so before this date in order that they can be considered.
