Breach of a Public Space Protection Order for failing to carry suitable provisions to remove dog faeces.

On 21st December 2023, the defendant appeared before Cwmbran Magistrates Court and entered a guilty plea. Mortimer was ordered to pay a fine of £40 and a £16 surcharge.

Anti-Social Behaviour Crime and Policing Act 2014, Breach of a Public Space Protection Order (Section 68).

Stacey Jayne Davies of Alexandra Street, Abertillery, NP13 3HL

Breach of a Public Space Protection Order for failing to carry suitable provisions to remove dog faeces.

On the 25th of April 2022, the defendant appeared before Cwmbran Magistrates Court and was found guilty. Davies was ordered to pay a fine of £100 prosecution costs of £120 and a £34 surcharge.

Darren Munkley, Glan Y Nant, Pengam

Breach of a Public Space Protection Order for failing to carry suitable provisions to remove dog faeces.

Heard at Cwmbran Magistrates on 30th December 2019.  The Defendant failed to enter a plea so the matter was proved in his absence. Munkley was fined £220, ordered to pay costs of £120 with a £30 surcharge.

Breach of a Public Space Protection Order for failing to carry suitable provisions to remove dog faeces.

Heard at Cwmbran Magistrates on 3rd March 2020. The Defendant failed attend or enter a plea so the matter was proved in her absence, where she was fined £100, ordered to pay costs of £120 with a £32 surcharge.

Michelle Dean

Dog Fouling offence – court hearing 18th November 2020.

Ms Dean did not enter a plea, so the matter was heard in her absence whereby she was fined £180, ordered to pay costs of £120 and a surcharge of £32.

Nadia Worgan of McDonnell Road, Bargoed CF81 8UD.
 

Household waste was found dumped on Gelligaer Common, near Capel Gwladys monument on the 18th October 2020.
Breach of a duty of care under section 34(2a) of the Environmental Protection Act 1990 for failing to take reasonable steps to ensure household waste is disposed of in the correct and proper manner. 

On the 24th August 2021, the defendant appeared before Newport Magistrates Court and entered a guilty plea. Worgan was sentenced to a conditional discharge, ordered to pay £185.66 costs and a victim surcharge of £22.

Leighton Davies Brynmynach Avenue, Ystrad Mynach.

Household waste found deposited on the lane between Hillside Terrace and Coed-Y-Haf, Tredomen on the 5th of February 2021.
Breach of a duty of care under section 34(2a) of the Environmental Protection Act 1990 for failing to take reasonable steps to ensure household waste is disposed of in the correct and proper manner.

On the 16th of September 2021, the defendant appeared before Newport Magistrates Court and entered a guilty plea. Davies was fined £150 and was ordered to pay £202.67 towards prosecution costs and a £34 surcharge.

Alex Jeffrey of Park Place, Abertillery
David Howells of Syndicate Terrace, Cwmfelinfach

Breach of duty of care for failing to dispose of commercial waste in the correct and proper manner.
Court hearing 11th November 2021, at Newport Magistrates Court.

Alex Jeffery pled guilty to disposing of commercial waste.
Alex Jeffery received a fine of £320, Prosecution costs of £256 and a victim surcharge of £32.
David Howells pled guilty to not making reasonable checks in that how the waste was being disposed of.
David Howell was fined £120, Prosecution costs of £256 and a victim surcharge of £30.
A total cost of £1014.

Alisha Legg of Croeso Square, Blackwood NP12 1WE.

Household waste found deposited on Gelligaer Common on the 10th April 2020.

On the 18th November 2021, the defendant appeared before Newport Magistrates Court and entered a guilty plea. Legg was sentenced as follows: ordered to pay a fine of £150, costs of £167.55 and a victim surcharge of £34.

Breach of a duty of care under section 34(2a) of the Environmental Protection Act 1990 for failing to take reasonable steps to ensure household waste is disposed of in the correct and proper manner.

Household waste found deposited on unnamed dirt track, Manmoel on the 8th of April 2019.
Breach of Environmental Protection Act 1990 Section 33(1) as the defendant deposited waste on land unlicensed to receive it.

On the 18th of November 2021, the defendant appeared before Newport Magistrates Court and entered a guilty plea. Bushell was sentenced as follows: ordered pay a fine of £200 prosecution costs £439.74 and a £34 surcharge.

Llanbradach

On the 18th September 2020 an illicit tipping incident was captured on CCTV taking place at Llanbradach Community Centre car park. The said offender was filmed emptying the contents from the boot of her vehicle onto a nearby grassed verge. The waste consisted of conifer cuttings, four small plastic sacks containing rubble, and a plastic container.

A hearing was listed at Newport Magistrates on 25th November 2021, but the defendant failed to attend and therefore an application was granted for an arrest warrant. The defendant was arrested on 13th December 2021 and appeared before Newport Magistrate’s Court. Ms Csepregi pled guilty and was sentenced to pay a fine of £400.00, prosecution costs of £400.00, and a victim surcharge of £40.00.
The total cost to Ms Csepregi was £840.00.

Margaret Roberts of William Street, Abertridwr

Breach of a duty of care under section 34(2a) of the Environmental Protection Act 1990 for failing to take reasonable steps to ensure household waste is disposed of in the correct and proper manner.
 
Court hearing 25th November 2021 at Newport Magistrates Court.
 

Margaret Roberts entered a guilty plea and was sentenced as follows: fined £100 and to pay prosecution costs of £221.96 and a victim surcharge of £34 a total cost of £355.96.

Valley Carpets Limited of Merthyr Tydfil

Breach of duty of care for not disposing of commercial waste in a proper manner, court hearing 25th November 2021, at Newport Magistrates Court.

alley Carpets Limited entered a guilty plea to the court.
Valley Carpets Limited received a fine of £1000, Prosecution costs of £326.18 and a victim surcharge of £100.
Clean-up costs were also awarded of £825.82.
A total cost of £2252.

Valley Landscaping and Construction Limited of Treorchy

Breach of duty of care for not disposing of commercial waste in the correct and proper manner. Court hearing 16th December 2021, at Newport Magistrates Court.
 

Valley Landscaping and Construction Limited entered a guilty plea to the court.
Valley Landscaping and Construction Limited received a fine of £1000, prosecution costs of £201.54 and a victim surcharge of £100.
Clean-up costs were also awarded of £825.82.
A total cost of £2127.36.

Breach of duty of care for not disposing of commercial waste in the correct and proper manner. Court hearing 14th January 2022, at Newport Magistrates Court.

Pengam Curry Limited entered a guilty plea to the court.
Pengam Curry Limited received a fine of £280, Prosecution and clean-up costs of £940.85 and a victim surcharge of £32.
A total cost of £1252.85

Household waste found deposited on unnamed lane below Church Farm, Mynyddislwyn on 5th June 2019.
Breach of a duty of care under section 34(2a) of the Environmental Protection Act 1990 for failing to take reasonable steps to ensure household waste is disposed of in the correct and proper manner.

On the 15th February 2022, the defendant appeared before Newport Magistrates Court and entered a guilty plea. Pritchard was sentenced as follows: ordered to pay a fine of £80, costs of £192.89 and a victim surcharge of £30.

Rebecca Davies of Gurnos Road, Merthyr Tydfil.

Household waste found deposited on lane leading to Ras Brynoer Farm, Rhymney on the 6th January 2021.
Breach of a duty of care under section 34(2a) of the Environmental Protection Act 1990 for failing to take reasonable steps to ensure household waste is disposed of in the correct and proper manner.

The defendant failed to attend a court hearing in November 2021 and a warrant was issued for her arrest. On the 6th of January 2022, the defendant appeared before Cwmbran Magistrates Court and entered a guilty plea. Davies was sentenced as follows: ordered pay a fine of £200 prosecution costs £249.08 and a £34 surcharge.

Jodie Watkins of Haydn Terrace, Merthyr Tydfil, CF47 9YJ

Household waste found deposited on Gelligaer Common on the 6th August 2021.
Breach of a duty of care under section 34(2a) of the Environmental Protection Act 1990 for failing to take reasonable steps to ensure household waste is disposed of in the correct and proper manner.

On the 17th of February 2022, the defendant appeared before Cwmbran Magistrates Court, entered a guilty plea and was sentenced as follows: ordered pay a fine of £150 prosecution costs £230.68 and a £34 surcharge.

Household waste found deposited at Gelligaer Common on 18th of August 2021.
Breach of a duty of care under section 34(2a) of the Environmental Protection Act 1990 for failing to take reasonable steps to ensure household waste is disposed of in the correct and proper manner.

On the 17th March 2022, the defendant attended court, entered a guilty plea and was sentenced as follows:

Carley Leanne Harvey of Fferm y Bryn, Ystrad Mynach, CF82 7BD

Household waste found deposited on the lane between Hillside Terrace and Coed Y Haf Tredomen on the 28th of April 2022, and a further offence on 1st May 2022 at Brynmynach Avenue, Ystrad Mynach.
Breach of a duty of care under section 34(2a) of the Environmental Protection Act 1990 for failing to take reasonable steps to ensure household waste is disposed of in the correct and proper manner.

On the 22nd of September 2022, the defendant appeared via video link at Cwmbran Magistrates Court and entered a guilty plea to the two offences. Harvey was fined £150 for each offence and was ordered to pay £400 towards prosecution costs and a £34 surcharge.

Keira Smith Styles of Snowden Court Lansbury Park, Caerphilly, CF83 1QS

Household waste was found dumped on Rudry Common Car Park on the 21st March 2023. Breach of a duty of care under section 34(2a) of the Environmental Protection Act 1990 for failing to take reasonable steps to ensure household waste is disposed of in the correct and proper manner.

On the 23rd November 2023, the defendant appeared before Cwmbran Magistrates Court and entered a guilty plea. Styles was ordered to pay £150 fine and £300 towards prosecution costs.

James Bryant of Bryn Siriol, Caerphilly 

On 27th May 2023 Bryant was witnessed depositing items of waste from his vehicle at Hendredenny Drive, Caerphilly. A full investigation was carried out by Caerphilly Council Environmental Enforcement Section. 

A hearing was listed at Cwmbran Magistrates on 11th January 2024. Mr Bryant was sentenced to pay a fine of £150.00, prosecution costs of £530.00, and a victim surcharge of £60.00.
The total cost to Mr Bryant was £740.00.

Callie Court of Blackwood 

On or around 14th January 2023, Court failed to ensure that the household waste generated at her residence was appropriately and responsibly disposed of. Subsequently, this waste was deposited by an unidentified individual at Blackvein Mountain Road, Crosskeys, on or around 14th January 2023.
 

A hearing was listed at Cwmbran Magistrates on 15th February 2024. Ms Court pleaded guilty and was sentenced to pay a fine of £100.00, prosecution costs of £284.42, and a victim surcharge of £40.00. The total cost to Ms Court was £424.42.

Miss Nicole Fisher of Hengoed

On 14th June 2023, Fisher was witnessed discarding an item of litter from her vehicle at Gallagher Retail Park, Caerphilly. A Fixed Penalty Notice was subsequently issued to the alleged offender, but this notice remained unpaid.

A hearing was listed at Cwmbran Magistrates on 15th February 2024. Miss Fisher was sentenced to pay a fine of £80.00, prosecution costs of £226.40, and a victim surcharge of £32.00. The total cost to Miss Fisher was £338.40.
